A Nigerian lawyer has called on security forces to arrest the chairman of the Independent National Electoral Commission, INEC, Prof Mahmood Yakubu, for breaking the electoral act during the presidential election on Saturday.
Mr Christopher Enemuo, an Anambra-based lawyer, claimed Yakubu breached the country’s election legislation by failing to strictly adhere to the use of the Bimodal Voters’ Accreditation System (BVAS), which also requires electronic transfer of results from polling stations to the INEC server.
In a news release signed and distributed to journalists in Awka, the lawyer demanded Yakubu’s immediate arrest.
“It is an offense for the INEC chairman not to use a tried and established method,” he stated.
Electronic devices, which are statutorily inherent in election standards, as stated in Section 60 of the Electoral Act.
“Section 60(6) is proof that a crime has been committed, and there is even a stipulated punishment for the offence.
“It was evident to Nigerians that the INEC chairman did not receive and declare results in the’manner’ required by him in the electoral act.
“The chairman himself admitted to committing this offense when he made it apparent to the public that transmissions ceased at a particular level and analogue switched over.
“The INEC chairman bears a substantial degree of responsibility for the illegality of the results and the proclamation of the presidential winner.”
“As a result, I believe the INEC chairman has committed an electoral offense and should be arrested immediately,” Enemuo said.
